German investors who have relied on the country's one-year tax-free holding period for crypto assets may need to prepare for a significant change. In an interview with BTC-ECHO, SPD politician Parsa Marvi confirmed that the governing coalition intends to bring taxation of crypto gains more closely in line with other forms of capital income, a shift that could remove the exemption altogether.
Under current German law, capital gains from certain crypto assets become tax-free once they have been held for more than a year. Other capital income, such as interest, dividends and gains from shares acquired today, is generally taxed regardless of how long it has been held. Marvi said this inconsistency is at the heart of the coalition's reform plans.
"Für uns Sozialdemokraten steht bei der Reform die Steuergerechtigkeit im Mittelpunkt. Wir haben uns mit unserem Koalitionspartner daher darauf verständigt, Gewinne aus Krypto-Werten und andere Kapitalerträge steuerlich stärker gleichzubehandeln," he said.
He elaborated on the disparity the reform is meant to address: "Nach geltendem Recht können Veräußerungsgewinne aus bestimmten Krypto-Werten nach Ablauf einer einjährigen Haltefrist steuerfrei bleiben. Zinsen, Dividenden und Gewinne aus heute erworbenen Aktien werden dagegen grundsätzlich unabhängig von der Haltedauer besteuert. Diese unterschiedliche Behandlung halten wir für überprüfungsbedürftig."
A possible 2027 start, with a 25 percent rate in view
The new regime could come into force as early as 2027, bringing crypto gains under the same capital income framework that currently applies a rate of 25 percent to other investment returns. Separately, the EU's DAC8 directive and Germany's domestic Kryptowerte-Steuertransparenz-Gesetz are set to improve the tax authorities' information base on crypto holdings, though Marvi's remarks make clear these measures do not themselves create new tax obligations — that would require the planned reform of the holding-period rule.
For investors who have built portfolios around the existing one-year exemption, the prospect of change raises questions about continuity. Marvi acknowledged the concern directly: "Uns ist bewusst, dass viele Anleger ihre Entscheidungen auf Grundlage der geltenden Rechtslage getroffen haben. Deshalb sind Vertrauensschutz und Planungssicherheit bei der Ausgestaltung einer Neuregelung wichtig."
He stopped short of detailing how such protections might be structured, citing the early stage of the legislative process: "Zum aktuellen Zeitpunkt des Gesetzgebungsverfahrens kann ich mit Blick auf die konkrete Ausgestaltung jedoch noch keine weitere belastbare Aussage treffen."
Early stage, no parliamentary procedure yet
Marvi was equally clear that the plan remains far from finalised. "Nach Abstimmung der Bundesregierung soll der Entwurf mit allen Ressorts abgestimmt werden. Er ist noch nicht Teil eines parlamentarischen Verfahrens," he said, indicating that the draft still needs to be coordinated across ministries before any bill reaches the Bundestag.
On the broader implications of scrapping the holding period, Marvi noted that the change alters the tax framework investors have operated under, while declining to offer firm predictions about its effects. He reiterated that supporting private wealth building remains a coalition priority: "Private Vermögensbildung ist und bleibt für uns – das möchte ich an dieser Stelle betonen – ein wichtiges Anliegen."
